Message from PUBLIC NOTARY No. 2
SPENCER, you said that notaries refuse to give a lower value in a deed not to be honest but to charge more for their fees ... I think that statement is wrong, because when we talk about the purchase of a property, notaries who are honest, they talk with both buyer and seller, and explain to them both scenarios ... sometimes there is a settlement between them, but ultimately it is the buyer who has the last word.
Obviously if the buyer agrees to declare a lower value, he has to know in advance that at the time he decide to sell his property, he will have to pay a lot of income taxes.
THE RESPONSIBILITY OF THE NOTARY IS ONLY IF HE DIDN'T EXPLAIN TO THE BUYER THE CONSEQUENCES OF ACCEPTING THE AGREEMENT.
SPENCER, Dices que los notarios se reúsan a dar un valor menor a una escritura no porque sean honestos si no para cobrar más sus honorarios... pienso que esa declaración está mal dicha, pues hablando de escrituraciones, los notarios que son honestos hablan tanto con el comprador al igual que con el vendedor, y les explican ambos escenarios... algunas veces hay un arreglo entre ellos, pero al final es el comprador quien tiene la última palabra.
Obviamente si el comprador acepta que se declare un valor menor en su escritura, debe saber de antemano que al momento de vender su propiedad, se van a disparar los impuestos sobre la renta.
ES RESPONSABILIDAD DEL NOTARIO ÚNICAMENTE CUANDO ÉSTE NO LE EXPLICÓ AL COMPRADOR LA SITUACIÓN EN LA QUE SE ENCONTRARÍA SI ACEPTA ESTE ACUERDO.

If you brought a property, made a will,or a Power of Attorney in our Public Notary, would you please come and pick it up, we have no more space to keep it, if you did it during the last month, just call before, to be sure it is ready.

Huh? When did I say that? Notaries need to put the true value on the deed and show proof of transfer of funds and payment for compliance with anti money laundering laws. It is very difficult and a violation of laws to place a lower value on the deed now and could subject parties and notary to sanctions.
