FM3 expired

Read all the posts and do not see an answer for me

My FM3 expired in April, was out of the country and re-entered in May on tourist visa....can I apply for a NEW FM3 without paying penalties on the old one? Was just going to take a trip to US for new tourist visa but may not be able to leave in time.

It should work as alot of time has passed, probably 98% chance of no problems, even immigration has told us that it is best to get a new FM3 if more than a few months have passed and the old one expired but then again they change their minds alot, worth a try.

I recently got an e-mail from a lady who had let her FM3 expire. INM told her what Spencer said.
