I've read several posts on different threads that claim injury accidents require 48 hours in lock up while policia sort out the facts? Is that in fact the law or is it up to the Police?

I was involved in an injury accident, 3 people in the other vehicle were hospitalized, and our only delay was the 3 hour wait for the insurance adjuster and another 2 hours as he completed paperwork. We didn't receive a citation either. In this case it was the Federales handling the incident.

We were in an accident where both drivers were at fault. [Lesson learned - never tell husband, "you can slow down now, you've beaten that truck"] I was injured and taken to the little Emergency Hospital in Joco. Both drivers had insurance. Our adjustor arrived in about 15 minutes and husband waited several hours for their insurance adjustor.

I think the 48 hour lock up is an Urban Myth. Maybe in a fatality but not just an injury accident.

Could it be another Mexico phenomenon? Depends on where, when, how, and which law enforcement agency attends.

Depends on aggravating circumstances and how fast the insurance companies show up, if alcohol or drugs are suspected it usually takes 48 hours to get the tox screens back and then based off of those results or lack thereof and the severity of injuries or death the amount of bail can be set.
