Fraccs., assocciations, condos and such
What are the differences between a Fraccionamiento, an Association, and a Condominium?
They are all private. A fracc. is a parcel of land that is determined by the governing authority which sets the boundaries. It is generally governed by the developer until such time as an association or condominium takes over that responsibility.
An association is a group of people who come together voluntarily and establish themselves through proper procedures to be the regulating body of the fracc. Their bylaws must be in compliance with the laws of all levels of government above them. The key word is voluntarily. So a person may own a home within the fracc. but not want to become a member of the association. Of course then he will not have access to the services of that association which may or may not include water. If he chooses to apply for a membership in the association, he cannot be refused if he is in compliance with the bylaws and building codes of the association.
A condominium is a parcel of land subdivided into lots and governed by their own board. It is the method that gives the most autonomy and control to the residents. It may be free standing or it may be within a fracc. If it is within a fracc. and that fracc. has an association the entire condo may elect or not to join that association. Since the condo is a subdivided parcel, it is an all or none proposition.
Water is the most contentious of the services of an association. If the association holds the concession (more or less a lease) from the federal government, that association has the rights and responsibilities associated with it. The amount of water extracted is limited and taxed quarterly. The concession also states who may receive water and that is generally limited to members of the association. If an association or condo desires to obtain a concession, the well must be on their property for openers.
If the property to be served with water lacks a well, SIMAPA holds the responsibility to supply them with water and payment is made directly to SIMAPA by the individual property owner.
