As per Scotia Bank:

We would like to advise that effective August 1st 2016, there was a change to
our cash advance fees. The new fee of $3.50 applies when obtaining cash advance
at any Global ATM Alliance Bank ABM outside of Canada.

That would be for using a credit card to obtain cash. Debit cards are not a cash advance, the money is taken right out of your account.

Please correct me if I am wrong but that is how it appears to me

I just used it and wasn't charged anything. I agree that this is for cash advances using a Scotia debit/credit card.

Unfortunately, it seems as though some people on TOB don't know how to read instructions. They don't select 'NO THANKS' when the question is asked about charging a fee of 95 pesos for their transaction. They seem to think that it's a new thing, and that the bank is trying to rip them off. Others have tried to explain that this has always been an OPTION on this ATM, but it doesn't seem to help.

UPDATE AS PER SCOTIA TODAY:

I completely understand ******, our IT department identified a technical issue where by customers were being incorrectly charged for withdrawals made from Global ATM Alliance

And looking at the screens today, that $9.50 is an educational donation if you hit yes. So when withdrawing it is yes, yes, no & yes (if you what a receipt).
