I have an account with Bancomer with a debit card. It is also a Visa card. Somewhere I recently used it must have copied the card and went on a shopping spree and cleaned out 10,000 pesos. The bank says sorry but there is nothing they can do. My question is what protections if any are there with debit cards from mexican banks. I know my debit card from a US bank has protection against fraudulent charges and I am only responsible for $50 as long as I report it in a timely manner.

Banks always deny. You can file a claim against the bank with the Federal regulatory agency who oversees financial institutions. I do those claims and while there is no guarantee you'll get your money refunded, some people have so it is worth a try.

So if you help people file these claims and they don't get their dough back do you waive your fee?

I charge for preparing and filing the papers. I need to be paid, win or lose. Some attorneys want 40% of any money recovered. I charge $500 for the filing and preparing and then another $1,000 for the hearing. It is fair. Most offices charge more for immigration services and never have to leave Chapala!

So its a $1500 crap shoot? A hearing? All it took from me was a few trips to the bank to fill out a few forms and several phone calls and Bancomer credited my account.

BTW, you didn't (never do) provide the name of the government agency that oversees these types of situations involving banks. Keeping your cards close to the vest, I see. Very lawyerlike.

Sometimes you make 1,000 calls to the bank and get no response and the only recourse is to file a claim. 2 to 3 trips to Guad are required. My time is valuable, more than most and I'm not a charity.

It is like making a police report, sometimes they get the bad guys and sometimes they don't. People need to be paid for the work they do.

The first place you go is to the bank branch where you have your account. In person. The branch manager can start the process. I don't know why the hell you'd go to Guadalajara.

Banks will do their part to address your concerns but WILL NOT prepare the claim form for the federal agency nor file it for you in Guadalajara which is what you have to do when the bank refuses to refund your money which most do hoping you'll go away.

Obviously it is quickest, cheapest and easiest to start at the local bank level but many here have been jerked around by the local banks and it isn't easy dealing with them, especially when they've screwed up.

Solovino - If a surgeon performs an operation and the patient dies, isn't the doctor entitled to his fee? Same with a lawyer! He's done the work and has no control over the outcome so you takes your chances. Some will win and some will lose. Just like life!

Lawyers commonly work on contingency fees. Even your not really a lawyer friend says the same in an above post.

And I have yet to see wannabe post anything of value for free. Why didn't he give the name of the government regulatory agency that people can go to for FREE help? I know you are pretty damn dumb but take a guess and you might get lucky. Hint: Can't troll for customers if he gives readily available info away for free.

Thanks again for your responses. I am wondering if the fees your quoting are in Dollars or Pesos?

I think everyone might want to consider this with how they handle there banking with Mexican banks. I would say I am suprised that Mexican banks do have easy processes for handling fraud like the US but then again this is Mexico. We have to live with the good and the bad.

Beware other board members if you use a mexican bank with a VISA debit card. It seems there are a ton of places that are just waiting to copy your numbers and go on shopping sprees.

I don't know why youand Solovino have to resort to low blows but I have to admit Solovino does have a valid point. You could have included the name or a link to the government agency and then added in your offer of service to assist in the documents.
