Activists from the Ajijic delegation, won an amparo trial to ask the National Water Commission (CONAGUA) to provide information for the investigations carried out against a dredging, as well as the placement of a floating dock , on the shore of Lake Chapala on Alceseca beach.
Lawyer Julio Carmona, along with other activists from the delegation, filed the lawsuit with the Attorney General's Office (FGR) in June 2021.
On August 26 of last year, a letter was delivered to CONAGUA, asking it to intervene in the investigation. As there was no response, they filed an amparo on December 8, the same to which the Eighth District Judge in Administrative Matters gave a resolution on January 20, to request an immediate response from CONAGUA.
“The amparo was the process to follow as there was no response from CONAGUA in the complaint for the federal crime of dredging. The National Water Commission has to intervene together with the Prosecutor's Office, to carry out the necessary investigations for the case,” Carmona said.
Likewise, the activist asserted that the process was truncated by the lack of information by the commission, however, after the resolution of the amparo trial, they have to respond as soon as possible.
Julio Carmona explained that after CONAGUA answers what corresponds to it, what follows is for the FGR to continue with the investigation, to continue with the criminal process.
For their part, both the lawyer and the activists will continue with the complaint process, making the corresponding follow-ups, and exhausting the possible measures to reach a verdict. “Participation and support has been very important to us. We are going to continue until we have the final resolution, ”he added.
Finally, the plaintiff considered that winning the amparo serves as precedent and aid, for future cases on issues of the lake and federal invasion. “It was done by the way established by law, what was established without skipping any process. It will be a precedent that will serve them in the fights that follow.”
